Terms of Service
These Terms of Service (the “Terms”) govern your use of iameasytouse.com and the services offered by I am Easy to Use LLC. By using this site or engaging our services, you agree to these Terms.
1. Who We Are
I am Easy to Use LLC is a North Carolina limited liability company — a one-person studio. We design and build websites and host them (operating as IBYDO), make apps and software, and produce podcasts and publications. “We,” “us,” and “our” refer to the company.
2. Acceptance of Terms
You must be at least 18 years old and able to enter a binding contract to use our paid services. Where a project-specific document (such as a signed proposal or web-design agreement) conflicts with these general Terms, that document controls for that engagement.
3. What We Offer
Our work spans several areas, and some pieces have their own terms:
- Web design & hosting — design, development, copywriting, domain setup, hosting, and maintenance, delivered under a separate written quote or agreement.
- Apps & software — applications and tools, some released as open source on public repositories under their own licenses.
- Podcasts — serialized audio fiction and other original audio works.
- Publications — independent editorial and commentary. Opinions and fiction are exactly that, not professional advice.
Some offerings link to separate properties (our own and third parties’) that operate under their own terms.
4. Use of This Website
We grant you a limited, personal, non-exclusive license to view this site for informational use. You agree not to disrupt or overload the site, scrape it abusively, attempt unauthorized access, or use it for any unlawful purpose.
5. Quotes, Pricing & Payment
Paid engagements are governed by a separate, pre-agreed quote. Work beyond the agreed scope requires a new quote. Hosting and maintenance may be billed on a recurring basis. Late payment may result in suspended hosting or withheld deliverables. Quotes exclude third-party costs and taxes unless stated.
6. Intellectual Property & Ownership
The names, logos, glyphs, text, and design of this site are owned by us or our licensors. For client projects, you own the final deliverables and the content and design of your pages once you have paid in full; we retain the underlying tools, frameworks, and reusable components we use to build them. Third-party and open-source assets remain under their original licenses. Editorial and fiction content remains the property of the company or its authors. We may display completed client work in our portfolio unless you object in writing.
7. Your Content & Conduct
If you provide content for a project, you warrant that it is lawful, accurate, and yours to use. You may not submit or request unlawful, infringing, deceptive, or harmful material, and you may not attempt to disrupt any site we operate.
8. Third-Party Services & Links
We rely on third parties — including our hosting provider, domain registrars, and font services — and we link to other properties. We are not responsible for the availability, content, or practices of third-party services, and your use of them is at your own risk and subject to their terms.
9. Disclaimers
Our services and this site are provided “as is” and “as available,” without warranties of any kind. We make no guarantee of any particular result — including traffic, search ranking, leads, sales, or revenue. Commentary and fiction we publish are for general interest and are not professional, legal, medical, or financial advice.
10. Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, or punitive damages. Our total liability for any claim is limited to the amount you paid us for the specific project in the three months before the claim arose, or USD $100 if you have paid us nothing.
11. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your content, your use of our services, or your violation of these Terms.
12. Termination
Either party may end ongoing services with reasonable notice. Work already performed and the current billing period are non-refundable. We may suspend or terminate access immediately for non-payment or violation of these Terms.
13. Governing Law & Disputes
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. The exclusive venue for any dispute is the state and federal courts located in North Carolina. The parties agree to attempt a good-faith resolution before starting formal proceedings.
14. Changes to These Terms
We may update these Terms from time to time. Changes take effect when posted, with a new “last updated” date. Your continued use after a change means you accept it.
